Privacy Policy

GENERAL

All personal data communicated by the user on this site are processed in accordance with the law of 1 August 2018 on the organisation of the National Commission for Data Protection and the general data protection regime, the Act of 1 August 2018 on the protection of individuals with regard to the processing of personal data in criminal matters and in matters of national security and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (RGPD).

DEFINITIONS

“personal data” means any information relating to an identified or identifiable natural person

“processing” means any operation or set of operations which is performed upon personal data or sets of personal data, whether or not by automatic means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction

“controller” means the natural or legal person, public authority, agency or other body which alone or jointly with others determines the purposes and means of the processing

Tasks of the DPO :

inform and advise the controller or processor as well as the employees who carry out the processing on their obligations under national and European data protection law;

monitor compliance with Regulation (EU) 2016/679, other national and European data protection provisions and the controller’s or processor’s internal data protection rules, including the allocation of responsibilities, awareness-raising and training of staff involved in processing operations, and related audits;

providing advice, upon request, on the data protection impact assessment and verifying its execution;

cooperating with the supervisory authority

acting as a contact point for the supervisory authority on matters relating to the processing, including prior consultation, and consulting as appropriate on any other matter.

THE KEY PRINCIPLES OF PERSONAL DATA PROTECTION

Personal data must be :

processed lawfully, fairly and transparently with regard to the data subject ;

collected for specified, explicit and legitimate purposes and not further processed in a way incompatible with those purposes;

adequate, relevant and limited to what is necessary for the purposes for which they are processed

accurate and, where necessary, kept up to date;

kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which they are processed;

processed in such a way as to ensure appropriate security of personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, using appropriate tech

YOUR RIGHTS

You have the rights listed below. For more details, you can consult the indicated articles of the GDPR.

1. Right of access (Article 15)

You have the right to obtain confirmation as to whether or not personal data relating to you are being processed by Omada and, if so, access to such personal data as well as other information such as, inter alia, the purposes of the processing or the recipients of the data.

2. Right of rectification (Article 16)

You have the right to obtain the rectification of personal data concerning you that are inaccurate and that incomplete personal data be completed.

3. Right to erasure (Article 17)

You have the right to obtain the erasure of personal data concerning you if the processing of such data is no longer justified.

4. Right to restriction of processing (Article 18)

You have the right to obtain the restriction of the processing of your data under certain conditions provided for by the GDPR.

5. Right to portability (Article 20)

You have the right to receive your personal data provided to Omada in a structured, commonly used and machine-readable format, and you have the right to transfer this data to another controller.

6. Right to object (Article 21)

You have the right to object at any time, on grounds relating to your particular situation, to processing of your personal data based on Article 6(1)(e) or (f) of the GDPR, including profiling based on these provisions. Omada will no longer process personal data unless it can demonstrate compelling legitimate grounds for the processing or for the establishment, exercise or defence of legal claims.

In addition to the identity verification procedure explained below, you may contact Omada to exercise your rights.

Identity verification procedure

With reference to Article 12(6) of the GDPR, Omada must have sufficient safeguards in place to establish with certainty the identity of the information seeker.

Omada offers two possibilities to make a request to exercise your rights:

REGISTRATION FORM

The registration form that you will submit as part of your application contains personal information. This information will be stored in our information system by Omada for the purpose of processing reservations. This data will be processed and stored for the period necessary to fulfil our obligations.

In accordance with Regulation (EU) 2016/679 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, you have a right of access, rectification, deletion, limitation of processing of your data as well as a right of objection and a right to portability of your data.

To exercise any of your rights, you can contact Omada by following the identity verification procedure described above.

By submitting the registration form, you agree to the processing of your personal data in connection with your application.
